Cancellation and Suspension of Certification

Cancellation and suspension of certification are integral processes within quality assurance and regulatory compliance frameworks. These measures are implemented to uphold the integrity of certification programs, ensuring that certified products consistently meet required standards.

Suspension of License or Certificate of Conformity:

  • Manufacturers are required to suspend the use of their license promptly and notify the Bureau if they encounter difficulties in maintaining product compliance or conformity or due to unforeseen circumstances such as natural disasters or legal directives.
  • The suspension may be revoked once deficiencies are rectified, with immediate notification sent to the Bureau within seven days of revocation.
  • Manufacturers must suspend their license and inform the Bureau when relocating processing activities to new premises.
  • The Bureau may revoke suspension after thorough verification, including confirming readiness to resume operations at new premises and assessing both old and new processing facilities.
  • The Bureau reserves the right to suspend a license if evidence of non-compliance or non-conformity to specified requirements is found. This evidence may include various factors, such as the use of the license on non-conforming products or major deviations in technical file implementation.
  • Manufacturers whose licenses are suspended must cease using the license or Standard Mark and dispatching products bearing the Standard Mark. They must promptly confirm compliance with corrective actions taken.
  • The Bureau may conduct on-site assessments to verify corrective actions and may revoke suspension upon satisfactory demonstration of conformity to specified requirements.

Cancellation of License or Certificate of Conformity or Refusal of Renewal:

  • The Bureau may cancel a license or certificate of conformity or refuse renewal if the manufacturer engages in misuse, makes false declarations, violates license conditions, or engages in unfair trade practices.
  • Before cancellation or refusal of renewal, the Bureau must provide the manufacturer with a written notice, allowing the opportunity to provide a written explanation and request a personal hearing.
  • If no explanation is received within the specified timeframe, or if the Bureau finds the explanation unsatisfactory, cancellation or refusal of renewal may proceed.
  • The decision regarding cancellation or refusal of renewal is communicated to the organization along with the grounds for the decision.

If specified requirements are withdrawn without replacement, any associated license is deemed cancelled, and the organization must surrender the license to the Bureau promptly.
