Introduction to the Clarification Regarding Air Conditioner (and its related parts), Hermetic Compressors, and Temperature Sensing Controls
The Department for Promotion of Industry and Internal Trade (DPIIT), under the Ministry of Commerce and Industry, Government of India, has issued a clarification to the earlier Quality Control Order dated 5th December 2019.
This clarification is issued to provide temporary relief and clear guidance to manufacturers and importers dealing with air conditioning and refrigeration products.
The amended notification is officially called the Air Conditioner and its related Parts, Hermetic Compressor and Temperature Sensing Controls (Quality Control) Amendment Order, 2025.
Key Changes of the QCO You Should Know
As per this clarification issued by the Government:
- A new provision has been added to the existing QCO of 2019
- Hermetic Compressors up to 2 TR (7000 W capacity) are given a temporary exemption
- The exemption applies only to manufacturers of air conditioning and refrigeration equipment and related parts, and that too on an actual user basis
Exemptions to this QCO
As per the newly inserted provision:
- Hermetic Compressors up to 2 TR (7000 W) capacity are exempted for one year
- The exemption applies only to manufacturers of air conditioning and refrigeration equipment
- Goods supplied must be used on an actual user basis
- After the expiry of one year, full compliance with the QCO will be required
What is the Date of Implementation?
- This Amendment Order, 2025, comes into force from the date of its publication in the Official Gazette
- The one-year exemption period for eligible Hermetic Compressors starts from this date
Now, What to Do?
Manufacturers and importers should:
- Review whether their Hermetic Compressors fall under the 7000 W (2 TR) limit
- Check eligibility for the one-year exemption
- Maintain proper records for the actual user-based supply
- Prepare in advance for full BIS compliance once the exemption period ends
- Monitor future updates or extensions, if any, from DPIIT or BIS
Early planning will help avoid disruption after the exemption period.
