Introduction to the Aluminium and Aluminium Alloy Products (Quality Control) Order, 2023
The Aluminium and Aluminium Alloy Products (Quality Control) Order, 2023 has been issued by the Central Government under the BIS Act, 2016, in order to ensure quality as well as standardization of specified aluminium products in India. Under this Order, the notified aluminium and aluminium alloy products must comply with the relevant Indian Standards and bear the BIS Standard Mark. The Order becomes applicable six months from the date of its publication in the Official Gazette, with extended timelines of nine months for small enterprises and twelve months for micro enterprises. The Bureau of Indian Standards is the designated authority for certification as well as enforcement, and any non-compliance may attract penalties under the BIS Act, 2016.
However, this Order has been recently amended through the Bureau of Indian Standards (BIS).
Key Changes You Need to Know
An update has been issued by the Ministry of Commerce and Industry in the form of the "Aluminium and Aluminium Alloy Products (Quality Control) Amendment Order, 2024," slated to be effective from September 26, 2024. The principal aim of this order is to uphold the quality standards of Aluminium and Aluminium Alloy Products.
- This order will be called the Aluminium and Aluminium Alloy Products (Quality Control) Amendment Order, 2024.
- It shall come into force from the official date of its publication in the official gazette.
- The implementation date has been extended to 26 September 2024.
- Until December 26, 2024, small enterprises, as defined under the Micro, Small, and Medium Enterprises Development Act, 2006, are exempt from the provisions of this order.
- Micro enterprises, as defined under the same Act, are granted exemption until March 26, 2025.
What is the Date of Implementation?
The date of implementation for this new amendment to the Aluminium and Aluminium Alloy Products (Quality Control) Amendment Order is September 26, 2024.
Now, What to do?
Although the implementation timelines have been extended, BIS certification will become mandatory for aluminium and aluminium alloy products as per the amended Quality Control Order. In order to ensure uninterrupted business operations and timely compliance, manufacturers and suppliers are advised to:
- Identify whether their aluminium and aluminium alloy products fall under the notified scope of the amended QCO.
- Initiate or continue the BIS ISI certification process.
- Plan product testing and sample evaluation as per the relevant Indian Standards.
- Maintain complete technical as well as quality documentation, including test reports and manufacturing details.
- Small and micro enterprises should utilize the extended exemption period to prepare for compliance before the revised deadlines.
- Regularly track notifications and clarifications issued by the Ministry of Commerce and Industry, as well as the BIS.
