Introduction to the BIS Guidelines for Implementation of Migration to IS/IEC 62368-1:2023

The Bureau of Indian Standards (BIS), under the Ministry of Electronics and Information Technology (MeitY), has recently issued a new notification, introducing updated guidelines for a wide range of electronic and IT products.

Earlier, a few notified products were covered under standards like IS 13252 (Part 1):2010 and IS 616:2017. When this new IS supersedes the previous Indian Standards, it specifically mentions Extended Reality Products (Augmented Reality, Virtual Reality, Mixed Reality, etc.), to conform to the newly introduced IS/IEC 62368-1:2023.

Now, this new and updated safety standard, which mentions IS/IEC 62368-1:2023 has been introduced, which will gradually replace the old standards, now for multiple product categories such as laptops, mobile phones, TVs, printers, CCTV cameras, and more.

Key Changes You Should Know

  1. A new standard, IS/IEC 62368-1:2023, has been introduced for safety requirements of electronic as well as IT equipment.
  2. This new standard will replace IS 13252 (Part 1):2010 and IS 616:2017 for a wide range of products.
  3. The transition period to conform to the newly introduced IS is till 1 November 2028.
  4. After this date, the old standards will be completely withdrawn for the products that have been notified in the latest update.

Note:
For a complete list of products that will be migrated to the notified Indian Standard, please refer to the attached PDF below.

Implementation Guidelines for Licensees

Existing license:

  1. They must update their products as per the new standard by 1 November 2028, after which penalties may be incurred.
  2. They have to submit fresh test reports from BIS-recognized labs to ensure compliance.
  3. They will have to provide declarations or undertakings for all models that fall in the notified categories.
  4. In some cases (such as TVs, mobile phones, CCTV), additional standards or requirements must also be followed along with the new standard.

New applicants:

  1. They can apply under old or new standards only till 1 November 2028.
  2. These applicants must shift to the new standard before the deadline, as beyond the implementation timeline, no new license will be granted.

Change in Scope of License:

All provisions as mentioned above will apply if there is any change in the scope of the license. Non-compliance will result in penalties, and no new license under the old standard will be provided beyond the transition period.

What is the Date of implementation?

  • These guidelines are effective immediately.
  • The last date for transition is 1 November 2028.

Now, What to Do?

  • If you are an existing BIS license holder, start planning your transition to IS/IEC 62368-1:2023 early, even though the deadline is far ahead.
  • Get your products tested as per the new standard and submit updated reports through the BIS portal.
  • Ensure all your product models (including series models) are aligned with the new requirements and submit necessary undertakings or declarations.
  • New applicants should ideally apply directly under the new standard in order to avoid future rework and delays.
  • Keep track of timelines and avoid last-minute compliance, as failure to comply can lead to cancellation of the licence or rejection of applications.
  • Plan certification, testing, as well as documentation in advance since this update impacts a large number of product categories.
