Introduction to the Imposition of EC under BWM Rules, 2022

The Ministry of Environment, Forest and Climate Change (MoEF&CC) had earlier notified the Battery Waste Management (BWM) Rules, 2022 on 22nd August 2022 in order to ensure environmentally safe handling, recycling, as well as disposal of waste batteries in India.

These rules made producers, refurbishers, and recyclers of batteries responsible for proper waste management and compliance with prescribed obligations. In order to ensure accountability, Rule 13(3) of the BWM Rules specifically empowered the Central Pollution Control Board (CPCB) to frame guidelines for imposing penalties in case of non-compliance.

Now, based on this provision, the CPCB has finalized detailed guidelines for imposing Environmental Compensation (EC), which have been officially approved and are all ready for implementation.

    2. Refurbishers

  4. They were developed after consultation with stakeholders.
  5. The draft guidelines were discussed in the 3rd Implementation Committee meeting that was held on 2nd August 2024.
  6. CPCB submitted the final guidelines to MoEF&CC on 22nd August 2024.

What is the date of implementation?

  • The MoEF&CC approved the EC guidelines on 9th September 2024
  • With this approval, the guidelines are now ready for implementation with immediate effect. 

This means Environmental Compensation can now be imposed as per these approved guidelines.
