Introduction to the BIS QCO for electrical appliances for Commercial Dispensing

The Bureau of Indian Standards (BIS), a ministry of commerce and industry, is the national organization responsible for ensuring the quality, reliability, and safety of products manufactured and sold in India. To enhance product safety and standardization in the electrical industry, the Government has been publishing Quality Control Orders (QCOs) on certain occasions, and BIS certification is therefore mandatory for notified products.

In the past, the Electrical Appliance for Commercial Dispensing and Vending (Quality Control) Order, 2023 was announced to place such appliances under compulsory certification of BIS. This requirement has been reiterated in the current notification dated 5 March 2024, which specifically stipulates the timelines of implementation, particularly among micro and small enterprises, which would guarantee a gradual and systematic method of implementation in the interest of the public.

Products That Fall under the QCO

This Quality Control Order will cover the following types of products:

Commercial dispensing and vending of electrical appliances: IS 302 (Part 2 / Section 75): 2018

Key Provisions of the Order

  1. All the notified products must be mandatory in terms of complying with the relevant Indian Standard.
  2. Goods should be marked with the Standard Mark (ISI Mark) in the BIS license.
  3. One has to be certified as per Scheme-I of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018.
  4. Bureau of Indian Standards (BIS) is chosen as the certifying and enforcing body.
  5. This Order does not apply to products produced within the country and exported.
  6. Any violation of the Order will be subject to the penalty provided under the Bureau of Indian Standards Act, 2016.

What is the Date of Implementation?

Depending on the classification of the enterprise, the schedule of enforcement is as follows:

  • General manufacturers:

The Order follows 6 months of its publication in the Official Gazette.

  • Small enterprises:

Relevant after 9 months of the date of publication.

  • Micro enterprises:

To be applicable after a period of twelve months since the date of publication.

Enterprise classification will be in accordance with the Micro, Small, and Medium Enterprises Development Act, 2006.

Now, what to Do?

Manufacturers and importers of commercial dispensing and vending electrical appliances are expected to:

  • Evaluate product applicability in the notified QCO.
  • Find the applicable Indian Standard ( IS 302 Part 2/Sec 75:2018).
  • Carry out product testing in a BIS-recognised laboratory.
  • Make up technical records and compliance records.
  • Request BIS ISI Mark certification within a relevant timeframe.
  • Make sure it is compliant without interruption so that it is not subject to penalties or market restrictions.
  • It is highly recommended to take early steps to avoid the last-minute compliance problems.
