Introduction to the Transition Facilitation (Quality Control) Order, 2026

The Government of India has been introducing various Quality Control Orders (QCOs) across multiple product categories in order to ensure that goods manufactured, imported, or sold in India comply with the prescribed Indian Standards and are certified by the Bureau of Indian Standards (BIS). While these Quality Control Orders help improve product quality, consumer safety, as well as manufacturing standards, businesses often face practical challenges during the transition to mandatory compliance.

In order to facilitate smoother implementation without compromising product quality, the Government has now introduced the Transition Facilitation (Quality Control) Order, 2026. This new Order establishes a structured transition mechanism that allows eligible companies to continue the supply of products that are covered under specified Quality Control Orders through BIS-certified manufacturers, subject to Government approval and strict quality oversight.

Key Changes You Should Know

Many companies need time to meet new BIS certification requirements. This Order provides a temporary and regulated transition mechanism so that eligible businesses can continue supplying products through BIS-certified manufacturers while completing their compliance process. Here is all about the Transition Facilitation Order that businesses need to know for the time being:

1. Eligible companies can apply: Business entities that are eligible can apply for Government permission in order to source products from manufacturers who are holding a valid BIS licence during the transition period. A Specific Permission will be provided to eligible businesses under this Transition Order.

Here is the eligibility criteria, as specified in the Order, for companies that can apply:

  • They must be registered under the Companies Act, 2013.
  • They must meet the eligibility criteria decided by the Government (to be further clarified by the DPIIT separately).
  • They must successfully clarify the assessment conducted by the Implementation Committee.

2. Applicable products for this Order: This Transition facilitation Order mainly applies to the following products that have been notified by the various Quality Control Orders:

  • Toys
  • Footwear
  • Air Conditioners and related components
  • Domestic Water Heaters
  • Washing Machines
  • Hinges
  • Furniture
  • Household, Commercial, and Similar Electrical Appliances

3. BIS Certification is still mandatory: This Order does not remove the requirement for BIS certification. Products must continue to meet applicable Indian Standards and carry the Standard Mark under a license from the Bureau of Indian Standards as per Scheme II of Schedule II to the BIS (Conformity Assessment) Regulations, 2018.

For a clearer understanding, refer to the table below:

Earlier PositionCurrent Position Under the Transition Order
Products generally followed the BIS Scheme-I certification process.Listed products can now follow the BIS Scheme-II route under this Order.
Factory inspection was a key part of certification.Certification mainly focuses on product testing under Scheme-II.
Compliance was based largely on factory assessment.Compliance is based on the Scheme-II requirements for listed products.
Businesses mainly prepared for factory inspections.Businesses must now check product eligibility, complete testing, maintain documents, and obtain specific permission from the DPIIT.

4. Application Assessment by the BIS officials: Before granting approval, the Government will review the technical capability, compliance history, product quality systems, manufacturing and supply change arrangements, along with future plans for manufacturing and R&D in India.

5. BIS Market Surveillance: Even after granting the approval, BIS will continue monitoring products in the market in order to ensure that they comply with Indian Standards.

6. Application Window: Applications can be submitted for 24 months from the date the Order came into effect.

7. Validity of the Order: Effective from 25 June 2026, this transition facilitation Order will be valid for 5 years, unless it is extended by the government. However, if the permission is already granted, it will remain valid for the approved period.

Also Note:

  • Detailed clarity on the exact process and portal integration is awaited.
  • Further guidelines regarding the online portal, application process, and related concerns will be issued separately by DPIIT.

Important Dates to Remember

  • Implementation Date of the Transition Facilitation Order: 25 June 2026.
  • Application Period: 24 months from the date of publication of this Order.
  • Order Validity: 5 years, unless further extended by the government authorities.

What Does This Mean for Businesses?

  • If your products are covered under any notified Quality Control Order, this new regulated transition framework may help you continue business legally during the transition period, subject to Government approval.
  • A specific permission by the DPIIT under Scheme II will be granted to help them continue functioning in the Indian market.
  • Applicable products can be sold using this permission to ensure compliance in India.

However, if any incorrect or false information is submitted, the product fails to comply with the specifications, or the conditions of this Order are violated, the government may suspend or withdraw the permission.

Note: Businesses are advised to wait for further clarity regarding eligibility and criteria.
